Land Use and Planning Administration

We have wide-ranging experience in land use and planning administration legal services.  We have worked extensively with the Helping Expedite and Advance Responsible Tribal Home Ownership Act of 2012 (“HEARTH Act”), including drafting leasing regulations to submit for Secretary of the Interior for approval as well as the submission process.  We also have in-depth knowledge regarding the Indian Long-Term Leasing Act of 1955 (“ILTLA”), under which the Bureau of Indian Affairs (“BIA”) approves leases on tribal land.  We can assist in the lease submission process from start-to-finish, including drafting leases and corresponding resolutions, compiling submission packets, and submitting and finalizing leases with the BIA.  We are also familiar with the buying and selling of fee land real estate as well as the fee to trust land process.  We also appreciate the importance of understanding the land use issues affecting each of our tribal clients in order to implement laws and regulations to address such issues when planning for future land developments. Because of this, we have successfully assisted tribal clients with developing land use plans and drafting zoning ordinances and related procedures, including variance applications and building permit applications, all with an eye toward the unique land and cultural concerns of our tribal clients.
